Data Subject Access Requests (DSARs)

Key notes:

  • Organisations have already seen a significant increase in the number of DSAR’s received since the introduction of the GDPR in May.
  • Data must be provided to data subjects free of charge.
  • There are also fewer exceptions for a data controller to refuse a DSAR.
  • Data controllers must now respond within one month, as opposed to 40 days.
  • Data controllers may no longer charge a fee when providing a data subject with details of their personal data.
  • The GDPR mandates that additional information, such as details around data retention periods, the extent of automated decision-making used and the source of personal data, will have to be provided upon a data access request.
